TripWithMe - Terms of Service

Scope

These Terms of Service govern the use of the mobile application TripWithMe (hereinafter referred to as "App") and all related services.

By registering and using the App, you agree to these Terms of Service. If you do not agree with these terms, you may not use the App.

The App is operated as a private project and serves exclusively for the joint planning of trips and events.

Service Description

The App enables users to jointly plan and organize trips and events. The use of the App is designed for private, non-commercial purposes.

The App offers the following features, among others:

Creation and management of trips and events
Invitation and management of participants
Group chats for communication within travel groups
Shared pinboards for sharing information, links and media

The App is in continuous development. There is no claim to availability of all features at all times. We reserve the right to change, add or remove features.

Registration and User Account

Registration is required to use the App. During registration, you must provide truthful and complete information. You are obliged to keep your access data secret and protect them from access by third parties.

Each person may only create one user account. The creation of multiple accounts is not permitted.

You are responsible for all activities carried out under your user account. If you suspect unauthorized use of your account, you are obliged to inform us immediately.

Use of the App is only permitted from the age of 16. Minors under 16 require the consent of a legal guardian.

User Obligations

As a user, you agree to use the App exclusively within the framework of applicable laws and these Terms of Service.

The following is particularly prohibited:

Distribution of illegal, offensive, defamatory, pornographic, glorifying violence or otherwise offensive content
Harassment, threats or discrimination against other users
Distribution of spam, advertising or unsolicited messages
Use of the App for commercial purposes without prior consent
Attempting to gain unauthorized access to the systems or data of other users
Distribution of malicious software, viruses or similar
Manipulation or disruption of the App's technical infrastructure
Impersonating another person or falsifying your identity
Systematic collection of data from other users (screen scraping, crawling, etc.)

You are solely responsible for the content you create, upload or share in the App. This includes in particular messages in group chats, entries on pinboards and uploaded files or media.

Reporting Violations and Account Suspension

Reporting Mechanism

Users can report violations of these Terms of Service or applicable law. Reports can be sent to [email protected]. Please describe the violation in as much detail as possible and provide relevant information (e.g. username, time, type of violation).

Right to Block and Delete

We expressly reserve the right to take appropriate action in the event of violations of these Terms of Service or reported abusive behavior. This serves to protect all users and the integrity of the platform.

Reasons for blocking or deletion may include:

Violation of these Terms of Service
Violation of applicable law
Harassment, threats or discrimination against other users
Distribution of illegal, offensive or objectionable content
Multiple reports by other users
Abuse of App features
Other serious reasons that justify exclusion

Review Process

We review each report. We reserve the right to decide at our own discretion when reviewing. The review usually takes place within 7 working days. In urgent cases (e.g. criminally relevant content) we can act immediately.

Temporary Suspension

For first-time or minor violations, a temporary suspension of the user account may be imposed. The duration of the suspension is at our discretion and can range from 24 hours to 30 days. No access to the App is possible during the suspension.

Permanent Suspension

In the case of serious or repeated violations, we reserve the right to permanently suspend the user account. A permanent suspension results in permanent exclusion from using the App. Creating a new user account is not permitted after a permanent suspension.

Deletion of User Account and All Data

In particularly serious cases, especially in the case of criminally relevant violations, we reserve the right to completely delete the user account including all associated data. This also includes all messages and content shared in group chats. Recovery is not possible after deletion.

Appeal Against Suspensions

You can appeal against a suspension or deletion in writing by email to [email protected] within 14 days. We will review your appeal and inform you within a reasonable period whether the suspension is upheld or lifted. The suspension remains in effect during the appeal process.

Warranty and Liability

The App is provided as a private project "as is". We strive to provide a stable and secure service, but cannot guarantee error-free operation or constant availability.

We assume no liability for content created, uploaded or shared by users. Responsibility for this content lies exclusively with the respective users.

We are only liable for damages based on intentional or grossly negligent behavior on our part. Liability for slight negligence is excluded, unless damages from injury to life, body or health or from violation of essential contractual obligations are concerned.

We are not responsible for data loss caused by technical problems, server failures or other circumstances. We recommend that you additionally back up important data.

Availability of the App

We strive to keep the App available as continuously as possible. However, there is no claim to specific availability. Maintenance work, technical disruptions or other circumstances can lead to interruptions.

We reserve the right to discontinue the App in whole or in part at any time. In the event of permanent discontinuation, we will inform you in good time and give you the opportunity to export your data.

Copyrights and Usage Rights

All rights to the App, including design, code, graphics and other content, belong to the operator or the respective rights holders. The App and its content are protected by copyright.

You receive a simple, non-transferable right to use the App for its intended purpose. Use is limited to private, non-commercial purposes.

For content that you upload or create in the App, you grant us a non-exclusive, worldwide, royalty-free right of use, insofar as this is necessary for the operation of the App and the provision of functions. This right of use expires when you delete the content or close your account.

Termination of Use and Account Deletion

You can delete your user account yourself at any time. Deletion is done via the corresponding function in the App settings. After deletion, your personal data will be removed within 30 days.

Please note that content you have shared in group chats may remain visible to other group members even after deleting your account until the respective trip is deleted.

We reserve the right to delete user accounts that have been inactive for more than 12 months after we have previously informed you by email.

Changes to Terms of Service

We reserve the right to change these Terms of Service at any time. Changes will be communicated to you by email or via the App. If you do not agree to the changes, you can delete your user account.

Unless you object to the change within 4 weeks of notification, the changed Terms of Service are deemed accepted. In case of objection, the right to use ends.

Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these Terms of Service be or become invalid, this does not affect the validity of the remaining provisions.

There are no side agreements to these Terms of Service. Changes and additions require text form.
